The efficiency of the procedures related to the state registration of rights to real estate will be improved.

The government decision will establish the mixed contracts for purchasing real estate and mortgages with the participation of credit organizations authorized to provide bank or mortgage loans, or exemplary forms of mixed contracts for the sale and purchase of real estate and mortgages, which will allow the relevant contracts to be signed without notarization, in accordance with the exemplary form approved by the government and through the electronic services platform of the Cadastre Committee. This will facilitate the simplification of the process of providing electronic services, increase the efficiency of procedures related to the state registration of rights to real estate, as well as ensure a more predictable and uniform implementation of processes for citizens and financial organizations.

As noted by the head of the Cadastre Committee, Suren Tovmasyan, a template will be integrated into the electronic system that will allow, in the presence of a mortgage loan, for the buyer, seller, and bank to remotely sign and validate the contract in the electronic system, which will serve as the basis for state registration of rights, and the ownership right will be transferred from the owner, that is, the developer, to the buyer acquiring it with mortgage financing, who can validate the contract both in Armenia and outside its borders.

According to the head of the Cadastre Committee, under the current legal regulation, a person acquiring real estate must either be in Armenia and physically visit a notary or provide a power of attorney to someone. “In this case, considering that the bank checks all necessary parameters of the buyer, financial resources, and the possibilities and capabilities of servicing the mortgage loan when providing the mortgage loan, we are introducing an institution whereby, without notarization, after the tripartite contract is signed in the electronic system, it will be submitted by the bank for state registration of rights, and this will serve as the basis for the buyer to have the opportunity to remotely acquire real estate from a newly constructed building in Armenia or from a building that has already been completed and put into operation, without visiting a notary and without ensuring the relevant power of attorney procedures,” said Suren Tovmasyan.

Tigran Khachatryan noted that the procedure is being simplified by the decision, as the requirement for notarization is removed. “Secondly, we trust more in the technologies used in the digital environment. The government continues its work in the direction of digitization.”

The executive has also adopted a decision that aims to clarify the procedures for submitting applications and documents for the state registration of rights and restrictions on property electronically, ensure uniform application of regulations in the context of relationships arising with the participation of legal entities, as well as banks and credit organizations authorized to provide mortgage loans, increase the efficiency of verifying submitted documents and electronic digital signatures, and reduce legal and technical issues arising during practical implementation. As a result, the efficiency of providing electronic services for state registration will increase, ensuring a more clear, predictable, and properly organized implementation of the process.

The government decision will ensure the proper and complete implementation of the regulations established by Article 47.3 of the Law on “State Registration of Property Rights.” In particular, it will establish the procedure for submitting the necessary documents for the state registration of the buyer's ownership right over the property being alienated for the purpose of ensuring the public interest electronically to the state real estate register. This will contribute to the digitization of document circulation, reduction of paper procedures, increase the efficiency of interaction between competent authorities, as well as accelerate the processes of state registration of rights to real estate and ensure transparency. At the same time, it will ensure a unified and predictable procedure for the submission of necessary documents by the bodies involved in the process of property alienation for the purpose of ensuring public interest, reducing administrative burdens and excluding non-uniform practices in document submission.
